China’s Covid lockdown guidelines ship costs larger

BEIJING — Covid-related restrictions have increased production costs for Chinese electric car start-up WM Motor, even as existing chip and battery shortages are driving up costs, CEO Freeman Shen told CNBC.

“Adding all these things together, this industry is a fast-growing industry, but the cost part of the equation is also going to be a challenge,” Shen, also founder and chairman of WM Motor, said Wednesday.

Sales of new energy vehicles — which include battery-only and hybrid-powered cars — more than doubled last year in China, the world’s largest automobile market. The country has become a hotbed for electric car start-ups and a launch pad for many traditional auto giants making the shift to electric.

China quickly controlled the local spread of the coronavirus in 2020 by imposing swift lockdowns on cities and neighborhoods. But after the emergence of the highly transmissible omicron variant, some analysts started to question whether the costs of the zero-Covid policy now outweigh the benefits.

The impact is already being felt by factories. A Chinese ministry overseeing manufacturing said this month the lockdowns would be a drag on industrial production in the first quarter.

Shen laid out the impact of Covid-related restrictions on his start-up:

  • A chip manufacturer in Malaysia had production problems and stopped delivering to Bosch China, which then stopped delivering to WM Motor.
  • Within China, after Covid cases emerged in Nanjing, one of WM Motor’s battery cell suppliers stopped deliveries.
  • In the last few months, similar disruptions affected two of the company’s suppliers in the Shangyu district of Shaoxing city, near Hangzhou.
  • Covid-related restrictions on the Ningbo port area also stopped delivery from three suppliers there.

“So, all these things were killing us,” Shen told CNBC.

Automakers around the world have cut production due to a shortage of semiconductors. Geopolitical tensions and overwhelming demand for chips in the wake of the pandemic contributed to a shortfall in supply that has lasted for more than a year.

Shen said he expects the chip shortage to improve in the second half of this year, based on conversations with his start-up’s 11 chip suppliers.

Electric car battery shortage

However, he pointed to another looming problem that could get worse: Rising raw material costs for batteries.

Battery-grade lithium carbonate prices were up more than 500% year-on-year as of earlier this month, according to S&P Global Platts. The firm’s survey of industry insiders released this week found that 80% of respondents expect those lithium prices to remain high this year — about four times higher than the start of 2021.

The battery shortage will likely worsen as demand for electric cars in China picks up in the second quarter, Shen said. For 2022, he expects electric car sales in the country to nearly double from last year to about 5 million vehicles.

Reassessing a Japanese manufacturing model

One of the reasons the pandemic disrupted the supply chain is that factories have historically used a longstanding Japanese model of “just-in-time” or lean manufacturing, in which factories only purchase parts as needed to reduce costs and increase efficiency, Shen pointed out .

But now, the strategy is changing.

“In order to make sure you can deliver your car, you probably will start thinking: We have to waste some of our money to keep some stock,” he said. “For a car company, the biggest loss would be losing the sales to your customer.”

Part of WM Motor’s sales strategy is to work with property developers to open test drive sites in more residential neighborhoods, while building up the cars’ autonomous driving capabilities such as in parking, Shen said.

He said the company will need to raise prices to cope with rising costs, as others in the industry already have.

For one, Tesla raised the price for its Model Y in China by 21,088 yuan ($3,300) in December to 301,840 yuan ($47,450), after subsidies. WM Motor’s cars are about half that price.

Travel restrictions affect business

Economists say China’s Covid-related travel restrictions affect consumer spending more than factories.

Cities frequently change Covid testing requirements for travel, while flights and train tickets can get canceled based on newly reported Covid cases.

These restrictions have also affected WM Motor, Shen said. The company has research and development, factory and other business-side operations in Shanghai, Chengdu, Zhejiang province and Hubei province, in addition to about 500 brick-and-mortar stores across the country.

He said the company had to use more technologies like virtual reality and augmented reality to help employees and customers communicate despite travel restrictions.

“We have to use this kind of technology, because if not, the user experience is going to be terrible, and the efficiency is going to be very bad. And we sometimes cannot even get things done,” Shen said.

Asked if he had any IPO plans, Shen said there was no news to announce on the listing front, and cited the pressing delivery issues.

“Obviously people had a lot of expectation, our investor had a lot of expectation, but we are very busy these days to deliver our product,” he said. “Hopefully we can get something to announce in the near future.”

General Electric suspended its Covid vaccine and testing requirements on Friday after the Supreme Court blocked the Biden administration’s mandate, a company spokesman told CNBC.

GE, which had 174,000 employees at the end of 2020, has encouraged its employees to get vaccinated, the spokesman said.

The conservative majority of the Supreme Court in a 6-3 decision, called the Biden administration’s requirements a “blunt instrument” that “makes no distinctions by industry or risk of exposure to Covid-19.”

In a statement following the court decision, President Joe Biden urged companies to voluntarily implement the vaccination and testing rules.

The American Medical Association, one of the largest medical associations in the US, contradicted that the Supreme Court blocked “one of the most effective tools in the fight against further transmission and death from this aggressive virus”.

    5. WINNER SELECTION AND NOTIFICATION

    a. Decisions of Station management with respect to the Promotion are final.

Winner(s) (or their parents or legal guardians if under the age of majority) must execute and return any required affidavit of eligibility and release, publicity release, and/or guest/traveling companion release within ten (10) days of notification attempt or winner will be disqualified and the prize will be forfeited.     6. CONDITIONS

    a. Payments of all federal, state and local taxes are solely the responsibility of the winner(s). Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.

    b.     ii. acknowledge that the Station reserves the right, in its sole discretion, not to use the Materials at all; and

    iii. represent and warrant that: you are 18 years of age or older; you have the full legal right, power and authority to grant to the Station the license provided for herein; you own or control the complete exhibition and other rights to the Materials you submitted for the purposes contemplated in this license; you are either the parent (or legal guardian) of any minor featured in the Materials or have received the express consent of the parent (or legal guardian) for any such minor to appear in the Materials and to enter the minor’s likeness in the Materials in the contest; and neither the Materials nor the exercise of the rights granted herein shall infringe upon or violate the right of privacy or right of publicity of, or constitute a libel or slander against, or violate any common law or any other right of, any person or entity.

    d. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Station in its sole discretion may require verification of Promotion winner’s or winners’ identification by a showing of valid government-issued photo identification.

    In the latest game, mother Stephanie and her nine year old son Dustin cook against her husband Dave and their six year old daughter Sienna.

    In the My Restaurant Rules-style challenge, the two teams compete for the best menu with points for taste and presentation.

    And Stephanie says the game was a huge hit, especially with her son excited to take the lead.

    “We win with three points,” she told FEMAIL.

    “We help them create the menu, but we mostly choose dishes that we all like to eat,” she said.

    In the first round of the restaurant there was Stephanie and Dustin’s menu.

    As a starter, the family had saganaki before dealing with dumplings for the main course.

    For dessert, the mother and son team served chocolate pudding with ice cream.

    A week later, the papa-daughter team set up their menu and served nigiri at the beginning, followed by a shrimp salad and kladdkaka, a Swedish chocolate cake, at the end.

    Stephanie said they are trying to do whatever they can to entertain the children despite the tight restrictions imposed by the Andrews government.

    “It’s hard, especially now that playgrounds are banned,” she said.

    The children proudly posed in front of their meals while they cooked. Dustin lost interest in preparing the physical menus, so Sienna did it for both meals.

    The mother posted photos of the experimental dinner challenge on Facebook, where she inspired dozens of others to start a cooking contest with their children.

    Norwegian Cruise can require Florida passengers to be vaccinated, decide guidelines

    Norwegian Cruise Line said Sunday that a federal judge ruled to temporarily suspend enforcement of a law in Florida that prohibits companies from requiring customers to provide proof of vaccination.

    U.S. District Judge Kathleen Williams issued the injunction that allowed Norwegian to request vaccine documents from customers while the case is on trial. The Norwegian Gem is scheduled to leave Miami on August 15th. It’s the cruise line’s first trip out of the state since the pandemic shut down the cruise industry more than a year ago.

    Infection numbers in Florida have increased 51% in the last seven days, according to Johns Hopkins University. The state reported 134,506 new Covid cases from July 30 to August 5, more than any other 7-day period tracked by the JHU, and the positivity of new cases is 18.9%.

    “It’s scary what’s happening in Florida,” said Derek Shaffer, an attorney for Norwegian Cruise Line, during a trial Friday to seek the injunction. “All of Florida is a hot spot … All we do is protect our employees and passengers.”

    Norwegian CEO Frank Del Rio said the company is trying to keep passengers and crew members safe.

    “The health and safety of our guests, our crew and the communities we visit is our top priority today, tomorrow and forever,” Del Rio said in a statement on Sunday. “It’s not a tagline or a tagline, we mean business, and our commitment to these principles is demonstrated by the effort our company has put into providing the safest cruise experience possible from Florida.”

    On Friday, Florida attorney Pete Patterson said the law protects customers’ civil liberties and prevents companies from discriminating against unvaccinated people.

    “You can’t discriminate against customers for refusing to give you information,” Patterson said.

    Had the cruise line not received the injunction and continued to request proof of vaccination for the upcoming trip, it could have been prosecuted under Florida law and fined up to $ 5,000 per passenger.

    In his argument, Shaffer said that “no cruise line in Norwegian ‘s position can afford” to withstand a fine of this magnitude. Shaffer claimed Florida lawmakers wanted “political points” in the vaccination debate.

    If the law stays in place, the cruise operator could be forced to cancel upcoming cruises or “sail in a way that’s worse for our passengers and crew,” Shaffer said.

    The company that operates the Norwegian Cruise Line, Oceania Cruises and Regent Seven Seas Cruises brands, filed suit against Florida surgeon general challenged the law in July.

    Norwegian attorney said the company had waited to file the lawsuit pending a federal appeals court ruling on another Florida case against the Centers for Disease Control and Prevention. The court sided with Florida, which claimed the CDC’s cruise ship regulations were too burdensome and cost millions of dollars in tax revenue.

    The cruise operator plans that all guests and crew members on its trips are fully vaccinated and must have Covid-19 tests before embarkation.

    On Friday, Norwegian announced that its second quarter loss rose to $ 717.8 million, or $ 1.94 per share, on revenue from $ 4.37 million. The company expects further losses until the shipping company can resume its regular trips.

    EU Takes One other Step to Harmonize Anti-Cash-Laundering Guidelines

    The European Union Banking Authority has proposed guidelines for financial compliance officers, another step in the bloc’s efforts to overhaul its anti-money laundering system.

    The proposal by the Paris-based European Banking Authority is the latest step by the EU to harmonize anti-money laundering rules in member states and to shift implementation from national authorities.

    The EBA’s proposal published this week begins a public consultation phase that ends in early November. The agency should then finalize the new standards.

    “This is a step to pave the way for the new EU-wide authority”, said David Pasewaldt, Frankfurt business defender at the law firm Clifford Chance LLP.

    While the EBA’s future role in combating money laundering is in the air amid plans to create a specialized anti-money laundering agency, the guidelines should have an immediate impact on financial institutions, lawyers said.

    The EBA said that its nearly 50-page proposal, for the first time, comprehensively lists the EU’s regulatory expectations regarding the establishment and management of anti-money laundering and terrorist financing programs by financial sector companies. The proposal outlines a framework for such programs with minimum requirements for the roles and responsibilities of compliance officers and board members.

    Although some member states already have similar anti-money laundering standards, Pasewaldt said the proposal should be helpful for financial institutions and their compliance officers due to its thoroughness and specificity. “The level of detail [the EBA’s guidance] contains is quite surprising, ”he said.

    The proposed policy would require that a member of the board of directors of a financial institution be specifically responsible for the company’s anti-money laundering program, although the rest of the board of directors also have responsibility.

    It also describes the responsibilities of anti-money laundering compliance officers, including customer due diligence and reporting suspicious transactions to national authorities. According to the proposal, compliance officers should report directly to the company’s management board.

    The proposed guidance states that strategic decisions related to anti-money laundering and terrorist financing programs should not be outsourced to third parties.

    The EBA also identified actions that national authorities should take, such as reviewing the technical expertise of a compliance officer upon appointment to ensure that he is qualified.

    One focus of the guidelines is the requirement for banks to appoint a Group Compliance Officer who is responsible for harmonizing a financial institution’s approach to anti-money laundering regulations in the member states. These guidelines are reminiscent of a directive that the EU adopted in 2015.

    The EBA stated that it had analyzed money laundering scandals and came to the conclusion that one cause was the lack of reporting lines between the local offices of the institutes and their group management bodies.

    According to Jasper Helder, attorney at the law firm Akin Gump Strauss Hauer & Feld LLP in London, the requirement is part of the responsibility for developing a unified, EU-wide approach to combating money laundering standards at the financial institutions themselves.

    “It’s pretty smart,” said Mr Helder. “If you did so, as an individual within such a transnational financial institution in charge of the group’s anti-money laundering program, would you accept that your organization in country A has different rules than in country B? Of course not.”
