A David And Goliath Fashion UGG Boot Dispute | Worldwide Legal professionals Community

Just over five years after California retail giant Deckers Outdoor Corp. (Decker) filed a lawsuit against Sydney-based shoe company Australian Leather Pty Ltd (Australian leather) The US Court of Appeals ruled in favor of Deckers for trademark infringement on the Federal Circuit.

The appeals court upheld the district court’s earlier ruling finding that Australian Leather had deliberately infringed Deckers’ “UGG” trademarks by selling fewer than 15 pairs of UGG branded boots in the United States and paid Deckers $ 450,000 Dollar damages and pending a permanent restraining order preventing Australian Leather (among other things) from using “the UGG trademark or name or any reproduction, forgery, copy or dyeable imitation thereof in any way and in any format, case or Spelled on or in conjunction with “the sale, offer for sale, distribution or promotion of any product in the United States or its territories.”

The litigation underlines that trademark owners and users with multiple jurisdictions must carefully examine whether any infringement problems may arise with regard to a general meaning of the trademark in the respective jurisdiction in which use (or even trademark protection) is sought. Trademarks that are distinctive and therefore protectable in one country can have a general meaning and are therefore not registrable or enforceable in another country. Likewise, acceptable use of a generic term in one jurisdiction may constitute trademark infringement in another.

Australian Leather is one of many companies in Australia that sells sheepskin boots under the umbrella of “ugg boots” without worrying about possible trademark infringement. This is because the term ‘ugg’ in Australia (and New Zealand) is generally considered to be a description of a certain type of sheepskin boot with fleece on the inside and a synthetic sole and that other traders may need to legitimately use the name ‘ugg’ to to describe similar products. On this basis, it was generally accepted that the term “ugg” or “ugg boot” cannot be registered as a trademark in Australia and New Zealand.

According to US trademark law, generic terms are also excluded from registration as a trademark. However, and unfortunately for Australian Leather, despite the fact that ‘ugg’ is a generic term in Australia, it is not in the United States.

While Deckers would not have the right to trademark the word “ugg” in Australia, it is the registered owner of a US trademark for the word “UGG” in relation to footwear. When Australian Leather sold 14 items labeled “ugg” to US customers in 2016, Deckers sued Australian Leather for trademark infringement. In response, Australian Leather argued that Deckers’ trademark registrations for “UGG” should be deleted as the term “ugg” is generic in the US as well as Australia and New Zealand.

Australian Leather also tried to rely on the US “foreign equivalents” doctrine to argue that the term is generic in Australia (as agreed by Australian Leather and Deckers), which means that the term is also used in the US should be viewed as generic. According to the doctrine of foreign equivalents, a person cannot register a trademark over a foreign generic word if the trademark would “prevent competitors from labeling a product as it is in the foreign language that their customers know best”. Australian Leather went ahead and filed counterclaims against Deckers alleging that Deckers was misleading consumers by suggesting that their products were made in Australia.

The decision

Despite Australian Leather’s arguments, in the U.S. District Court’s summary judgment for the Northern District of Illinois, while ‘ugg’ is a generic term in Australia, that alone is insufficient to infer a general meaning in the United States States “.

Regarding the Foreign Equivalents Doctrine, the District Court found that the doctrine “is not perfectly suited to English into English and is generally used to analyze non-English words used in the American market,” and In any case, “The doctrine is merely an expression of the prohibition on allowing a trademark to monopolize a generic term.” The court further stated that Americans familiar with the Australian use of the term (or Australian visitors to the United States ) “Would be misled into believing that there is only one brand of Ugg-style sheepskin boots in this country”.

The court also dismissed Australian Leather’s counterclaims, ruling that Decker had not misleadingly marketed their products as manufactured because Decker’s “UGG Australia” label did not state that the boots were made in Australia and that their products had a specific label of origin included in Australia.

When the matter went to court in May 2019, a jury found that Australian Leather had not only intentionally infringed Deckers’ registered trademarks, but had used a counterfeit version of its registered trademark. On this basis, the district court approved Deckers’ claim for damages and ordered an injunction against Australian Leather.

On appeal, Australian Leather argued that in examining whether “ugg” was a generic term, the District Court made a mistake and misapplied a test that may be relevant in circumstances where a brand name becomes generic as opposed to a term was generic even before the trademark was registered. However, on May 7, 2021, the U.S. Federal Circuit Court of Appeals upheld the District Court’s decision.

US sanctions Iran-based cash community funding Yemen’s Houthis | Battle Information

The U.S. Treasury Department on Thursday sanctioned members of a smuggling network that U.S. officials claim is helping to fund the Iranian Islamic Revolutionary Guard Corps and Iranian-affiliated Houthi fighters in Yemen.

Finance officials said the network, allegedly headed by Iran-based Houthi financier Sa’id al-Jamal, is channeling funds from the sale of Iranian oil through a complex network of intermediaries and exchange offices in several countries to the Houthis in Yemen.

“The financial support of this network enables the Houthis deplorable attacks threatening civil and critical infrastructure in Yemen and Saudi Arabia, “Andrea Gacki, director of the Treasury Department’s Office of Foreign Assets Control, said in a statement.

“These attacks undermine efforts to end the conflict and most tragically starve tens of millions of innocent civilians,” Gacki said.

The war that started in 2014 when Houthi fighters drove the Saudi Arabia-backed government from the capital, Sanaa, turned Yemen into the world’s biggest humanitarian crisis. According to the United Nations, more than 20 million people are in need of help and four million have been displaced from their homes. Tens of thousands of people have died.

US President Joe Biden has demanded an end on the proxy war in Yemen between Saudi Arabia and Iran and directed US officials to seek diplomatic solutions to the conflict.

“The United States is working to resolve the conflict in Yemen and to provide ongoing humanitarian aid to the Yemeni people,” said US Secretary of State Antony Blinken in a statement on Friday.

“It is time for the Houthis to accept a ceasefire and for all parties to resume political talks,” said Blinken.

In February, the US announced that it would cease “all American support for offensive operations in the war in Yemen, including relevant arms sales,” although Biden said he would continue to “help Saudi Arabia defend its sovereignty”.

Last week, a Attack with Houthi missiles killed 17, including a five-year-old girl, in the besieged Yemeni city of Marib.

At the same time, the Biden government officials lifted sanctions against three Iranian government officials and two companies previously involved in the trade in Iranian oil products.

Oil prices fell briefly on the news Thursday, but a US official told Reuters that lifting the sanctions was “routine,” and a State Department spokesman said the move was unrelated to multilateral talks to revive the Iran nuclear deal from 2015 to do.

A sixth round of negotiations between Iran and the world powers over the revival of the 2015 nuclear deal is on resume next weekend, just a few days before the presidential elections in Iran, which are expected to take place on June 18 new leadership to power in Tehran.

On Tuesday, Blinken said that even if Iran returns to compliance with the nuclear agreement known as the Joint Comprehensive Plan of Action (JCPOA), “hundreds of sanctions will remain in place”.

West Texas Intermediate crude rose to more than $ 70 a barrel on Thursday, its highest level in more than two years, amid optimism about strong economic demand in the US, Reuters reported.

Among those identified as the target of the newly announced U.S. sanctions on Thursday was Abdi Nasir Ali Mahamud, a Turkey-based Houthi supporter who allegedly coordinated petrochemical smuggling for Aldoon General Trading’s network and related businesses.

Manoj Sabharwal, a maritime manager in the UAE, Hani Abd-al-Majid Muhammad As’ad, an accountant in Turkey, and Jami Ali Muhammad, a Somali businessman, were also named for sanctions.

Two Syrian men, Tlaib Ali Husayn Al-Ahmad al-Rawi, based in Turkey and Abdul Jalil Mallah, based in Greece, are said to have enabled the transfers to an exchange office in Yemen that is close to the Houthis.

US Cyber Command desires more cash for community protection

WASHINGTON – US Cyber Command asked Congress for an additional $ 62 million to use the Department of Defense networks as part of its unfinanced priorities that did not make it into the command’s budget application for the budget year 2022

A copy of the list received from C4ISRNET indicated that Cyber Command noted the recent SolarWinds intrusion into various government networks in its request for money to help the DoD secure its own networks and respond to malicious cyber actions. The item topped a list of four unfunded priorities totaling $ 93.4 million.

The DoD has stated that SolarWinds’ massive breach of federal and commercial networks, which is attributed to Russia’s foreign intelligence service, has not compromised its own systems.

“I ask your committee to support these priorities … to help us strengthen military readiness and alliances, protect the homeland from cyberspace attacks, and advance national interests,” wrote General Paul Nakasone, Cyber Commander Command, in the proposal.

Cyber intrusions and ransomware incidents are taking on epidemic status, according to some cybersecurity analysts, prompting the federal government to prioritize response efforts.

In fact, most of the Pentagon’s $ 10 billion cyber request was requested $ 5.6 billion to protect IT systems.

Cyber Command’s Unfunded Priority # 2 is $ 23.3 million for cyber training. The command, by the service acquisition executives, is building an online training system called Persistent cyber training environment, which enables the armed forces to conduct individual and collective training as well as mission rehearsals.

The other two items listed are $ 3.2 million for human intelligence to help the command build an organic intelligence capability to access strategic targets and $ 4.8 million for acquisition personnel.

Cyber Command has been working for several years to build an acquisition structure with Congress, which in 2016 authorized a restricted procurement agency to act as the crawl, run, run to make sure the young commando got the plan up and running.

In the latest annual Defense Act, Congress removed the $ 75 million acquisition cap for Cyber Command and strengthened the commander’s powers to oversee programs and priorities. However, the services are still running large programs on behalf of the command and the joint cyber mission force.

The $ 4.8 million would be used to integrate the command Common cyber warfighting architectureguiding their acquisition priorities. Congress and the non-partisan Government Accountability Office gave the command bad marks for the architecture, citing integration and oversight problems. The command has since then tried to allay these concerns.
